These terms and conditions may change without notice, and any changes to this page will supercede any terms and conditions provided in earlier versions.
Privacy
We value your privacy, and will endevour to protect any personal or banking information that you might provide to us. We treat all of your communications confidentially and sensitively. Information such as bank accounts and credit card numbers will be destroyed as soon as payment has been processed, and you will never be charged without your full consent. No personal information will be provided to any third party without your full consent except where compelled by law.
No-Returns policy
Upson Downs has a strict no-returns policy. Under no circumstance will we provide an exchange, credit, or refund for any product or service. The sole exception is where a serious manufacturing fault is present in a print or other product, in which case at our discretion the product will be replaced with the same or similar product. This does not apply to damage incurred during shipping or any other time after leaving our studio. No returns will be accepted without prior authorisation.
Protecting our intellectual property
Purchasing a print or other product from Upson Downs does not include ownership of the image used in the print or product. What you purchase is the physical item (the print or other product), which could then conceivably be shown commercially in a gallery, resold to another party, etc. The ownership and copyright of the image is retained by Mick Scott and Upson Downs. In the case of obtaining a license to use an image for commercial purposes, such license will contain terms and conditions that will replace these terms and conditions.
The images on this site, and the site itself, including the source code, are the property of and is copyrighted by Mick Scott and Upson Downs. No image, whether in the gallery or elsewhere on the site, may be used or reproduced without the express, written permission of Mick Scott or another authorised representative of Upson Downs. That being said, we believe that fair use of this site includes:
- Using an unaltered image (including the copyright notice) as a background image on your personal computer only
- Using an unaltered image (including the copyright notice) on a free, publicly accessible website for the sole purpose of promoting and linking to this website (http://www.upsondowns.com.au)
- Viewing the source code of this website for educational purposes
It is expressly not permitted to alter any image on this site, including removing any copyright notice, and/or to use any image in a commercial situation (including charging money to view, access, or use an image, using an image in promotional material, or false representation of the ownership of the image) without a written agreement between yourself and Mick Scott/Upson Downs to do so. In the case of obtaining a license to use an image for commercial purposes, such license will contain terms and conditions that will replace these terms and conditions.
